No proper OTRS permission, no explicit release under the GFDL, and it seems doubtful that the subject (who was asked to release the picture) is also the copyright holder. –Tryphon☂ 19:27, 19 April 2009 (UTC)

Info I was the orginal uploader to Wikipedia; I contacted both the webmaster and the actress (Nadine Velazquez) herself via email to secure GFDL permissions to upload to Wikipedia. I did not plan to upload the image to Wikimedia Commons, though, because the permissions rules here are much more strict. — Loadmaster (talk) 14:46, 20 April 2009 (UTC)
- Keep as long as a formal OTRS request to the actual copyright holder is pending. The conditions expressed in the e-mail about article changes are okay in this case, because they're not conditions to use the image; they were merely conditions to release the image, and could be promptly reverted. Delete I just read the email exchange. I doubt the subject of the photo owns the copyright to it, but even if she does, she never gave explicit permission to freely license the image. I'm not sure why the user was insisting on GFDL—any free license would have worked—but she never said anything about that. Being on OTRS wouldn't change anything. She only said "I give you approval on the image". I'm guessing that means "I give you permission to use this image on my English Wikipedia article" (as implied by "if you do this and this to the article, I'll let you use it). It should be deleted on en.wp too (or used under fair use). Their policy is no different than ours in this regard. They're only less strict in their enforcement of the policy.
